Law of HR 4472 – the Adam Walsh Child Protection and Safety Act of 2006
From Title V - Child Pornography Prevention

Title V of HR 4472 amends 18 USC § 2257 – the federal labeling and record keeping law – so that “secondary” producers now have the same onerous record-keeping burdens as primary producers, and adds mere nudity to the list of content that comes under the reach of 2257.

Secondary producers are required to keep records, but, under the regulations, a secondary producer can obtain copies of the primary producer’s records, organize them, and make them available for inspection, so long as the secondary also records the primary producer’s name and address.

FBI Checking 2257 Records

We warned that it would be coming... the government is cracking down on law abiding mainstream adult companies to try and catch them violating 2257 regulations (which state that there must be proper documentation to prove that anyone photographed or filmed nude is 18 years or older.) The problem with these inspections is that to catch child pornographers you are not going to find them in mainstream adult companies.

Mainstream adult companies make too much money off of legitimate adult porn to risk losing it all by filming or photographing a minor... so it is most often a waste of tax payers money for FBI agents to be rifling through mainstream adult companies to catch a child pornographer. The real child pornographers are not going to have paperwork... because what they are doing is illegal. It is like the FBI raiding pharmacies to catch drug dealers.

FBI agents began inspecting records of their first mainstream adult video company Diabolic Video to review record keeping regulations of 18 U.S.C. §2257. It has been announced that there are several other mainstream companies that will be getting a visit from the FBI as well. These inspections are the first time any adult company had ever been visited in the 11 years that the regulations have been in effect to verify its compliance with the record keeping requirements of §2257.

Diabolic Video passed with flying colors, and the FBI is now working toward inspecting more legitimate companies to make sure they too are in compliance. It is quite frustrating that our government is wasting time on mainstream companies that have nothing to do with child pornography. There are real criminals out there and it would be nice to live in a world were a 'political show' to keep right winged voters thinking the government is actually doing something useful was the last thing we would waste our time on. It would be better if they would go after real child pornographers and not waste their time on legitimate adult companies as they smile to the press and say... look we are doing our job saving the world from child porn. Yeah, sure you are.
